Notifications to the Constitutional Court

In October the Government has repeatedly addressed the interpretation of constitutional provisions implemented during the campaign and asked the Constitutional Court on the issue of constitutionality of Article 13 of the Electoral Code.

ADEPT Note: Initially, a signed application requested to check the constitutionality of the provisions of Article 13 par.(3) let.a) of the Electoral Code in the context of the provisions of Article 96, 102 and 103 of the Constitution. According to the Prime Minister, the legal norm which imposes an obligation to suspend from office the members of Government is contrary to the provisions of Article 103 of the Constitution which establishes the principle of continuity of Government’s power, which must exercise its mandate unless the new Government is established. It was also mentioned that the obligation of the member of Government to suspend their positions may deprive the Government (in the absence of the quorum required by law) from the right to adopt decisions, which are the main instrument of Government in the law enforcement process and in the general public administration, and therefore may make it impossible for the Government to ensure, during the electoral campaign, the uninterrupted pursuit of the mandate, which would prejudice the Article 96, 102 and 103 of the Constitution. On 21st of October the Constitutional Court decided to cease the examination of that notification, based on procedural, formal grounds — as the notification to the Constitutional Court should be a decision assumed by the whole Government, and adopted under the established procedure. At the same time the received notification was signed only by the Prime Minister on his own behalf and has not been approved through a Government decision, adopted in a governmental meeting. On 28th of October the Government adopted the Decision approving the notification on constitutionality of Article 13 par.(3) let.a) of the Electoral Code, and the notification shall be examined by the Constitutional Court according to established procedure.

According to a decision of the Commission, 163 owners whose land was used for construction sites of victims’ houses in Cotul Morii and Nemţeni shall receive as compensation 912 thousand lei by total for the lost agricultural production. According to the Commission’s decision, 5974 farmers, who have lost their crops due to the floods from a total area of 5289 hectares, shall receive compensations in the amount of 1000 lei per hectare, the total value being 5.289 million lei, which is just the first instalment of compensations in this regard, and further decisions shall be adopted.
